Terms of sale

Article 1 — Purpose and scope

These terms of sale govern all sales concluded on headgrid.fr (the “Site”) between HeadGrid (the “Seller”) and any non-trade individual making a purchase (the “Customer”). Placing an order implies prior, express and unreserved acceptance of these terms, confirmed by a checkbox at payment time.

The Seller may amend these terms at any time; the version applicable is the one in force on the order date.

Article 2 — Seller identity

The Site is published and the products are sold by A. Saba, sole trader (entrepreneur individuel) trading as HeadGrid, registered in the French National Business Register under SIREN 991 932 401 (head-office SIRET: 991 932 401 00011), with registered office at Rue du Lieutenant André, 71100 Chalon-sur-Saône, France.

EU VAT number: FR78991932401. Activity: specialised distance selling (NAF code 4791B).

The Site is hosted by o2switch SAS, 222-224 boulevard Gustave Flaubert, 63000 Clermont-Ferrand, France.

Article 3 — Products

The products sold on the Site are decorative collectible pieces: replica helmets inspired by motorsport, made to order and customisable (size, visor, aerodynamic options, fittings) through the Site's configurator.

These products are intended exclusively for display and collection. They are in no way certified protective equipment and must never be used for driving, racing or any activity requiring a certified helmet.

Product photographs are as faithful as possible; minor variations in shade or finish may occur, as every piece is built and painted by hand.

Article 4 — Prices

Prices are shown in euros, all taxes included (VAT at the current 20% rate). Any delivery costs are shown to the Customer before final validation of the order.

The Seller may change its prices at any time; the applicable price is the one displayed when the order is validated. The amount charged is the one shown on the payment button, computed server-side from the catalogue and the chosen customisation options.

Article 5 — Ordering

The ordering process is: add products to the cart, enter an email address, accept these terms, enter the delivery address, then pay securely. The order is confirmed by a summary email sent to the address provided, including an order reference.

The Seller reserves the right to refuse or cancel any order in the event of an existing dispute with the Customer, legitimate suspicion of fraud, or payment failure.

Article 6 — Payment

Payment is made online by card or any other method offered at checkout. Transactions are processed by Stripe Payments Europe Ltd; the Seller never has access to full card details. The order is only final once Stripe has confirmed the payment.

Payment via Klarna is also offered: in instalments (up to three payments) for orders with a total amount of €1,500 (incl. VAT) or less, and as a single full payment above that amount. This service is provided by Klarna Bank AB under its own terms, shown at checkout, and subject to Klarna's approval.

Article 7 — Production and delivery

As every helmet is made to order, the indicative production time is 3 to 4 weeks from payment confirmation, plus shipping time. The Customer is kept informed of progress by email.

Deliveries are made to mainland France and to the countries offered at address entry (including Belgium, Luxembourg, Switzerland, Germany, Italy, Spain, the Netherlands, Portugal, Austria, the United Kingdom, Ireland and the Nordic countries).

In accordance with article L216-1 of the French Consumer Code, if delivery has not occurred within thirty days after the communicated indicative date, the Customer may cancel the order as provided by law. Risk passes to the Customer upon physical delivery. Any damage must be reported to the carrier on receipt and to the Seller within 48 hours at contact@headgrid.fr.

Article 8 — Right of withdrawal, returns and refunds

Under article L221-18 of the French Consumer Code, the Customer in principle has fourteen (14) days from receipt to withdraw from the purchase without giving reasons.

However, under article L221-28, 3° of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer's specifications or clearly personalised. HeadGrid helmets are made to order according to the configuration chosen by the Customer (size, visor, options) and fall under this exception: the right of withdrawal therefore does not apply to orders placed on the Site. The Customer is expressly informed of this before payment and accepts it by ticking the terms-acceptance checkbox.

Consequently, helmets cannot be returned, exchanged or refunded once payment is confirmed, except in the following case: a product received broken or in a significantly damaged condition. In that case, the Customer must report it within 48 hours to contact@headgrid.fr, with photographs of the product and its packaging, quoting the order reference.

After verification, the Seller will, at the Customer's choice and where possible, repair, replace or fully refund the order. Any refund is issued through Stripe, to the payment method used for the order, within a maximum of fourteen (14) days from approval of the claim.

Article 9 — Legal warranties

Regardless of the absence of a right of withdrawal, the Customer benefits from the legal warranty of conformity (articles L217-3 et seq. of the French Consumer Code) for two years from delivery, and from the warranty against hidden defects (articles 1641 to 1649 of the French Civil Code).

Under the legal warranty of conformity, the Customer has two years from delivery to act; may choose between repair or replacement of the goods, subject to the cost conditions of article L217-12 of the French Consumer Code; and does not need to prove the existence of the lack of conformity during the twenty-four months following delivery. The Customer may also invoke the warranty against hidden defects within the meaning of article 1641 of the French Civil Code and, in that case, choose between cancelling the sale or a price reduction (article 1644 of the French Civil Code).

Warranty claims are made to contact@headgrid.fr, quoting the order reference.

Article 10 — Liability

As the products are strictly decorative, the Seller declines all liability for use as protective equipment or any use inconsistent with their purpose. The Seller cannot be held liable for damage resulting from an external cause or force majeure.

Article 11 — Intellectual property

All elements of the Site (texts, photographs, logos, design) are the exclusive property of the Seller or are used under licence. Any reproduction without prior written authorisation is prohibited. Driver, team and competition names are cited solely as descriptive references for the collectible pieces; HeadGrid is not affiliated with any team, driver or championship organiser.

Article 12 — Personal data

Data collected at order time (identity, contact details, delivery address) is required to process the order and perform the contract. Its processing is described in the privacy policy available on the Site, in accordance with the GDPR.

Article 13 — Cookies

The Site sets strictly necessary cookies, exempt from consent: Stripe security cookies during payment (fraud prevention) and a session cookie for the internal admin area. The Customer's cart is stored locally in the browser (localStorage) and is only sent to the server at payment time.

With the Customer's consent (Accept / Decline banner), the Site also uses Google Analytics 4 for audience measurement. This consent can be withdrawn at any time via the “Cookies” link in the footer. No advertising cookies are used. Details are given in the privacy policy.

Article 14 — Complaints and disputes

Any complaint should first be addressed to customer service at contact@headgrid.fr, quoting the order reference. The Seller undertakes to respond promptly and to seek an amicable solution.

The Customer may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.

Article 15 — Governing law

These terms are governed by French law. In the event of a dispute not resolved amicably, the French courts have sole jurisdiction, under the conditions set by the French Code of Civil Procedure and Consumer Code.
